Federal Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Detention

A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without lawful basis.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case stems from a erroneous deportation to El Salvador earlier this year, which the government later admitted was an mistake. Following his repatriation to the United States to face alien smuggling charges, he was detained in immigration custody.

In her order, the judge noted that the government does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
